A town mayor in Surigao del Norte province is facing a one month suspension for issuing a special permit that allowed illegal cockfighting during a fiesta in a barangay.
Ombudsman Conchita Carpio-Morales ordered the suspension of Mainit Mayor Ramon Mondano for simple neglect of duty.
According to the Office of the Ombudsman, Mondano issued a special permit on June 14, 2016 to leaders of Purok Masaya for their cockfighting activities from June 20 to 22, 2016 to celebrate a fiesta in Barangay Matin-ao.
“However, it was found that no barangay clearance was issued for the cockfighting,” the Ombudsman said in a statement on Wednesday.
In its decision, the Ombudsman cited the Local Government Code which states that a barangay clearance is necessary before a municipality or city can issue such permit.
“It was not shown that the purok leaders of Purok Masaya applied for a barangay clearance, hence, respondent Mayor Mondano should not have issued the Special Permit in their favor,” the Ombudsman said.
While Mondano has authority as municipal mayor to issue special permits, the Ombudsman, however, pointed out the former should have required a barangay clearance before doing so.
“Although the issuance of special permits for special cockfighting activities is within his authority as municipal mayor, he is duty bound to require the presentation of the barangay clearance from Barangay Matin-ao before issuing a special permit to Purok Masaya. This he failed to do,” it added. By GD
